Terms Of Use
This site compares mattresses sold in Australia. It does not sell them. These terms set out what you can expect from us, what we expect from you, and — the part most of these documents bury — the things we are not responsible for.
By using this site you accept these terms. If you do not, please stop using it. Last updated 20 August 2026.
What this site is
We are a comparison publisher. We read manufacturers’ Australian product pages, warranty documents and trial conditions, score every mattress against the same ten criteria, and publish the result. Our method is set out on How We Rate.
What we are not:
- Not a retailer. Nothing is sold here. We hold no stock, take no payment, ship nothing and handle no returns.
- Not a party to your purchase. When you buy a mattress it is from that brand or retailer, under their terms, not ours.
- Not a testing laboratory. We do not buy these mattresses and sleep on them, and we do not run instrumented tests. Our scores come from documented specifications and published terms. About Us sets out exactly what we do and do not do.
We earn commission
We earn a commission when a reader buys through a link on this site, and those commercial relationships can affect which brands appear here and where they are ranked. We disclose this rather than bury it, because a comparison site that hides how it is paid is not much use to you. The full disclosure is on About Us, and what commission does not change — how each mattress is scored — is set out on How We Rate.
Commission costs you nothing. It does not change the price you pay.
Information, not advice
Everything here is general information about products. It is not advice about your situation, and we know nothing about your situation.
In particular, nothing on this site is medical advice. We publish pages about mattresses that suit people with back pain, and we are careful about how we word them, but a mattress is not a treatment. If you have back pain, joint pain, a sleep disorder or any other health concern, speak to a doctor, physiotherapist or other qualified health professional. Do not use a mattress ranking as a substitute for that, and do not delay getting help because a page here suggested a firmness.
Accuracy, and the fact that things change
We work carefully from the manufacturer’s own published material, and we correct mistakes when we find them. But prices change, promotions end, trial lengths get shortened and specifications get revised, sometimes without announcement. A page here is accurate as at the date we last checked it, and not necessarily on the day you read it.
Before you buy, confirm the price, the trial period, the warranty and the delivery terms on the seller’s own website. Those are the terms you will be held to, not the ones we have summarised.
If you find something on this site that is wrong or out of date, tell us. There is a contact form at the bottom of every page, and corrections are the most useful message you can send us.
Buying from a brand we link to
Your contract is with the seller. That means the seller — not us — is responsible for taking your payment, delivering the mattress, honouring the trial period, handling returns and dealing with warranty claims.
Your rights under the Australian Consumer Law also apply against the seller. Those consumer guarantees — that goods are of acceptable quality, match their description and are fit for purpose — cannot be signed away by anyone, including in a brand’s own terms. If a mattress fails to meet them, your remedy is with the business that sold it to you. We cannot process a return, escalate a warranty claim or refund you, because we never took your money.
Your Australian Consumer Law rights are not affected by these terms
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where anything else in these terms conflicts with that, this section wins.
Comments and anything else you post
You can comment on reviews without creating an account. Keep it lawful and keep it civil. Do not post:
- Anything unlawful, defamatory, harassing, hateful or threatening
- Someone else’s personal information, or your own beyond what you are comfortable seeing published
- Marketing, spam, or a promotional post for a brand without saying you are connected to it
- Content impersonating another person, or a review of a product you have not used
- Material you do not have the right to post
You keep ownership of what you write. By posting it you give us permission to publish, store and display it on this site. We may edit or remove comments, or decline to publish them, and we are not obliged to explain why in each case. We do not publish comments in exchange for payment.
Comments are the views of the people who wrote them. Publishing one is not an endorsement of it.
Using this site
Read it, share it, quote it with attribution. Do not:
- Interfere with the site’s operation or security, or attempt to gain access to parts of it that are not public
- Harvest content at a scale or rate that degrades the site for other people
- Copy our reviews or scores wholesale and republish them as your own
- Use this site to mislead anyone about what a brand offers
Content and trade marks
The reviews, scores, comparisons and written material on this site are ours. Brand names, product names and logos belong to their respective owners and are used here to identify the products being compared — which is what a comparison site has to do to be intelligible. Their appearance here does not imply that the brand endorses, sponsors or is affiliated with this site.
If you own a trade mark used on this site and want to raise something about how it appears, contact us and we will deal with it.
Links to other websites
Once you follow a link away from this site you are on someone else’s, under their terms and their privacy policy. We do not control those sites and are not responsible for their content, their availability, or what happens to you there. Our own Privacy Policy stops at our boundary.
Availability
This site is provided free of charge, and we do not promise it will always be available or free of errors. We may change, suspend or withdraw any part of it, including individual reviews and rankings, without notice.
Liability
There are things we are responsible for and things we are not, and we would rather draw that line honestly than write a paragraph pretending we are responsible for nothing.
What we do not accept responsibility for, to the extent the law permits:
- What the seller does. Delivery, the trial period, returns, warranty claims, and anything else that happens after you buy — that is between you and them, on their terms.
- Other websites. Their content, their availability, and what happens to you once you are on them.
- This site being down, slow, or temporarily missing a page. It is free, and we do not promise uptime.
What we do not try to sign away, because it would be wrong to and because the law would not let us anyway:
- Responsibility for taking reasonable care with what we publish. If we get a specification, a price or a warranty term wrong through carelessness, that is on us, and saying otherwise in our own terms would not change it.
- Liability for misleading or deceptive conduct. No set of terms can exclude that, and we are not going to write a clause that suggests it can.
Read plainly: we take real care with what we publish, and we would rather you told us about a mistake than sued us over one — but a mattress purchase is your decision, made on the seller’s terms, and the responsibility for that decision sits with you and them.
Changes to these terms
If these terms change, the version on this page changes with them and the date at the top is updated. Continuing to use the site after that means you accept the revised terms.
Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
“Non-exclusive” is the part that matters to you, so here is what it means. Nothing in this clause stops you bringing a claim in the courts of the state or territory where you actually live, and nothing in it stops you taking a complaint to an Australian regulator. We are not going to make you travel across the country to argue with us.
Contact
Questions about these terms, corrections, trade mark queries and complaints all go to the same place: service@top3mattress.com, or the contact form at the bottom of any page.
